Public Hearing Requirements & Procedures
  1. Filing an application: The applicant must submit complete application form(s) together with all required information and materials as outlined in table 2A of the Zoning Ordinance to the Community Development Department at:

  2. Costs: With the filing of a completed application(s), a $480 administrative fee and a $600 deposit (totaling $1,080) must be submitted. The deposit money is used by the city for payment of the costs of the publication of a legal notice in the newspaper, the services of a court reporter at the hearing, and the transcript of the hearing proceedings. Any balance remaining after these costs have been covered will be returned to the applicant. In the event the legal notice publication and public hearing transcript costs exceed the initial deposit, the city will require additional monies to be submitted.
  3. Applications and accompanying submittals are reviewed by the city: If the application(s) are complete, a public hearing date before the Plan Commission and/or Zoning Board of Appeals (ZBA) will be scheduled for a date determined by the volume of cases waiting to be heard, and to ensure adequate public notification of the public hearing according to state statute.   4. Hearing notice drafted: The city drafts a public hearing notice, listing the date, time, location, and purpose of the hearing. The city submits the notice to a local newspaper for publication in compliance with statutory requirements.
  5. Applicant mails notice to adjacent property owners: The applicant will be given a copy of the legal notice / notice of public hearing, and in keeping with statutory requirements, must mail a copy of such notice to the owners of properties located within 250 feet (excluding rights of ways) of the subject property, by certified / return-receipt requested mail. All returned receipts must be provided to the Plan Commission recording secretary the day of the public hearing.   6. Sign display: The city drafts public hearing sign language, stating the subject of the public hearing, the type of action being requested, and the date, time, and location of the public hearing. You will be given a copy of such language, and must post a sign that reflects such language in the front yard of the property.
  7. Prior to the public hearing meeting: No later than the end of the day on Thursday of the week before the public hearing, the applicant must submit 15 sets of documents (application, site plan, elevations, and anything pertinent to your request) to the Community Development Department. These sets are distributed to the Plan Commission / ZBA, City Council, and city staff in advance to allow adequate time for review prior to the public hearing.
  8. Public hearing: A formal public hearing is held before the Plan Commission and/or ZBA. This board is comprised of citizens who serve as appointed volunteers, and is a recommending body. The applicant and/or a representative will be required to attend the meeting to present the proposed project and answer any related questions.
  9. Recommendation to City Council: The Plan Commission and/or ZBA send their recommendations to either approve or deny the request to City Council. The City Council has final authority to grant or deny the request.
  10. City Council action: Should the City Council approve the request, it directs staff to draft an ordinance. The ordinance returns to the City Council for two “readings” as part of the final approval process. (The council will consider written requests to waive the second reading of the ordinance.)
  11. Issuance of permit: Once the ordinance has been approved, a permit can be issued for the project.
  12. Estimated length of time: If all requirements are met, the process generally takes approximately two and a half to three months.
